Welcome to Ai.Decksy.com! These Terms of Use (“Terms”) govern your access to and use of our Service.
1. Legal Entity
The Service is provided by Clarketic OÜ, a company registered at Harju maakond, Tallinn, Kesklinna linnaosa, Narva mnt 7-636, 10117, Estonia.
2. The Service
We provide access to an MVP (Minimum Viable Product) AI presentation generation service (the “Service”) on a subscription basis.
3. Subscription and Payments
Model: Access to the Service is provided via subscription. By selecting a plan, you agree to pay the associated fees on a recurring basis (e.g., monthly or annually).
Payment: Payments are processed by our third-party partner, Solidgate https://solidgate.com/ . You agree to provide current and accurate payment information.
Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it.
Cancellation: You may cancel your subscription at any time through your account settings. The cancellation will take effect at the end of the current paid term; you will retain access until that time.
Refund Policy: All payments are non-refundable. We do not provide refunds or credits for partially used subscription periods or unused Service.
4. Intellectual Property (Content Ownership)
This is the most critical section for an AI service.
Your Content (Inputs): You retain all rights to the text prompts and any other materials you upload to the Service. You grant us a non-exclusive, worldwide license to use this content solely for the purpose of providing the Service to you (i.e., generating your presentation).
Our Service: We retain all rights to the Service itself, our brand, interfaces, and underlying technology.
Generated Content (Outputs):
Assignment of Rights: To the extent permitted by law, we assign to you all rights we have in the presentations generated by the Service (“Output Content”).
Your Responsibility: You are solely responsible for your use of the Output Content. You must ensure it does not infringe upon any third-party rights (e.g., copyright, if the AI generates content similar to existing works).
Disclaimer: Due to the nature of AI, we cannot guarantee the uniqueness of the Output Content. Other users may receive identical or similar results.
5. Acceptable Use (Prohibited Actions)
You agree not to use the Service to:
Create illegal, harmful, abusive, or discriminatory content.
Attempt to reverse engineer, hack, or decompile the Service.
Resell access to the Service or use it in violation of any law.
6. Disclaimer of Warranties
The Service is an MVP and is provided “AS IS” and “AS AVAILABLE”.
We make no warranties, express or implied, that the Service will:
Be uninterrupted or error-free.
Meet your specific requirements.
That the AI-generated content will be 100% accurate, complete, or fit for your purpose.
7. Limitation of Liability
To the maximum extent permitted by law, Clarketic OÜ shall not be liable for any indirect, incidental, special, or consequential damages (including loss of data, profit, or reputation) arising from the use or inability to use the Service.
8. Data Deletion (Right to be Forgotten)
You may request the deletion of your account and all associated data at any time by sending a request to [email protected]
9. Changes to These Terms
We reserve the right to modify these Terms. We will notify you of material changes via email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Estonia.
